| Ruling Text: YOU ARE HEREBY ORDERED to SHOW CAUSE, before the New York State Racing and Wagering Board at its main office located at 1 Broadway Center, Suite 600, Schenectady, New York, 12305 at 10:00 A.M., Wednesday, June 11, 2008, pursuant to Section 309, subdivision 2 of the Racing, Pari-Mutuel Wagering and Breeding Law ("Racing Law"), and the Rules and Regulations of the New York State Racing and Wagering Board, 9 NYCRR Parts 4102.1 and 4119.11: Why your license to participate in pari-mutuel harness racing as a groom should not be denied, suspended or revoked, and/or a fine imposed pursuant to 9 NYCRR §4102.3(a)(1)-(4) for violation of the conditions of a voluntary agreement that you signed April 3, 2008, a copy of which is attached, because after having been arrested on March 22, 2008 for unlawful possession of Marijuana and other drugs, you refused to submit to a urine or blood test while on the premises at Monticello Raceway on April 1, 2008, and you failed to participate in the NYSRWB’s Drug/Alcohol Abuse Program, all in violation of 9 NYCRR §§ 4119.11 9(a) and (b).
