| Ruling Text: As trainer of record of the following horses : BIGGER HIT - 1st in 4th on 8/14/07, 2nd in 8th on 10/11/07 & 1st in 6th on 10/18/07, A BIT OF ADO - 1st in 9th on 10/3/07 & 1st in 11th on 10/10/07, STAR HUNTER - 1st in 3rd on 10/3/07 & 2nd in 7th on 10/11/07, FLYN AFTER MIDNIGHT - 1st in 5th on 10/4/07, KG'S FURY - 1st in 8th on 10/4/07, YEAH BABY N - 1st in 3rd on 10/9/07, NATURAL WOMAN N - 1st in 5th on 10/9/07, MILLWOOD MIDNIGHT- 3rd in 6th on 10/9/07, PANDORAS GAMBIT N - 2nd in 7th on 10/9/07, while the drug atropine was present in their system's in violation of the above stated rules. Your penalty for these violations shall be a cumulative suspension of five (5) years and a fine of five thousand dollars ($5000), except that $2500 of your fine and the final two-and-one-half (2.5) years of your suspension shall be stayed, and thereafter discharged, provided that during the next five (5) years you commit no violation of Board equine drug rules and that you fully comply with the terms of this ruling. If you do commit such a violation or fail to comply, then you shall serve this penalty in addition to any penalties imposed for the new rule violation(s). During the period of your suspension you are denied the privileges and use of the grounds of any N Y State racetrack. No horses owned, trained or driven by you shall be allowed to participate at any track conducting pari-mutuel racing. |
