| Ruling Text: As trainer of record of # 7 ROAD TO FAME that finished 1st in the 10th race on 11/13/07, your horse's TCO 2 level exceeded the acceptable level in violation of the above stated rules. Having filed an appeal, and paid the fine, your suspension is stayed until final determinination of the board. FINDING AND ORDER, 02/02/2009, Gail Pronti, ORDERED, that the charge is hereby dismissed on the ground that the evidence is insufficient to sustain the charge against respondent; and ORDERED, that no appeal was taken from the purse redistribution and disqualification of the horse “Road to Fame” ordered by the Presiding Judge after its November 13, 2007 race at Monticello Raceway. |
