Ruling Text: AFTER CAREFUL CONSIDERATION, YOU ARE HEREBY NOTIFIED THAT THE BOARD REFUSES TO ISSUE YOU LICENSES TO PARTICIPATE IN RACING IN THE STATE OF NEW YORK, FOR WHICH YOU APPLIED ON 3/9/07 AND 9/8/07, RECEIPTS# YR 1245387 AND YR 1257437, FOR THE FOLLOWING REASONS: YOUR EXPERIENCE, CHARACTER AND GENERAL FITNESS ARE SUCH THAT YOUR PARTICIPATION IN RACING OR RELATED ACTIVITIES WOULD BE INCONSISTENT WITH THE PUBLIC INTEREST, CONVENIENCE OR NECESSITY, OR WITH THE BEST INTERESTS OF RACING GENERALLY. YOU MADE A FALSE STATEMENT ON YOUR RACING LICENSE APPLICATION. FINDINGS AND ORDER, GAIL PRONTI, APRIL 28, 2008: ORDERED, that the refusal to issue a license to Respondent to participate in Harness Racing as a groom is affirmed. 4/28/08 The New York State Racing and Wagering Board adopted the recommendation of Hearing Officer Russell H. Baller, Jr. to uphold the license refusal of harness groom applicant Daryl Crapper based upon the finding that Mr. Crapper’s experience, character and general fitness are such that his participation in racing would be inconsistent with the public interest, convenience and necessity or with the best interests of racing generally.
