| Ruling Text: AFTER CAREFUL CONSIDERATION, YOU ARE HEREBY NOTIFIED THAT THE BOARD REFUSES TO ISSUE YOU LICENSES TO PARTICIPATE IN RACING IN THE STATE OF NEW YORK, FOR WHICH YOU APPLIED ON 8/29/07 AND 9/6/07 RECEIPTS# YR 1256998 AND YR 1257297 FOR THE FOLLOWING REASON: YOU HAVE VIOLATED THE LAWS, RULES OR REGULATIONS OF RACING IN ANOTHER RACING JURISDICTION (NEW JERSEY RACING COMMISSION, #03TRH42, 4/1/03). PERTINENT NEW YORK STATE LAW INCLUDES RACING, WAGERING AND BREEDING LAW 309(2)(d). FINDINGS AND ORDER, 10/3/2008, GAIL PRONTI: ORDERED, THAT RECIPROCITY SHOULD BE GRANTED BASED ON THE VIOLATIONS COMMITTED IN NEW JERSEY AND THE RELATED LICENSE SUSPENSION FOR PERIOD OF TEN (10) YEARS FROM THE INITIAL SUSPENSION DATE OF OCTOBER 10, 1998; AND IT IS FURTHER ORDERED THAT THE REFUSAL TO ISSUE LICENSED TO THE APPLICANT TO PARTICIPATE IN PARI-MUTUEL HARNESS RACING IS AFFIRMED, AND IT IS FURTHER ORDERED, THAT ANTHONY COLETTA SHALL BE ELIGIBLE TO APPLY FOR A HARNESS RACING LICENSE IN NEW YORK STATE ON OCTOBER 10, 2008. |
