| Ruling Text: Jockey Carlos V. Dominguez rider of the #6 horse "Cathedral Lodge" is suspended for 7 calendar days effective Monday September 24, 2007 through Sunday September 30, 2007 inclusive for interfering with the #1 horse "Sovereign Star" in the stretch during the running of the 5th race on Friday September 14, 2007. This suspension is stayed pending the outcome of Jockey Dominguez's appeal filed September 18, 2007. FINDINGS AND ORDER, May 29, 2008, Gail Pronti; The Respondent having received proper notice and participated in an appeal hearing conducted on October 31, 2007; and the Hearing Officer having rendered his report on April 16, THE BOARD, after due deliberation, hereby adopts the Hearing Officer’s findings of 2008, which is attached hereto and incorporated herein; and fact and conclusions of law, except based upon Mr. Dominguez’ improper riding during the race, the need to deter such conduct, and his extensive history of riding-related violations, the Board is increasing the suspension to thirty days. THEREFORE, upon the record, the Report of the Hearing Officer, and the findings and conclusions adopted herein, it is hereby ORDERED, that the suspension of Respondent, CARLOS V. DOMINGUEZ, imposed by the Stewards at Finger Lakes Racetrack is increased to thirty days, and the Stewards ruling is Affirmed in all other respects. Having received a hearing before the N.Y.S. Racing and Wagering Board concerning the running of the 5th race on Friday September 14, 2007 and the Board having upheld the Stewards Decision and amended the decision, Jockey Carlos V. Dominguez is suspended for 30 calendar days effective Friday June 13, 2008 through Saturday July 12, 2008 inclusive. |
