Ruling Text: You are hereby suspended 15 days reduced to 7 days for having waived your right of appeal September 11, 2007 through September 17, 2007 inclusive and you are fined $1000.00 for the finding of the drug Flunixin in the post race samples of horse Joaquin Memphis who finished 1st in the 5th race at Belmont Racetrack on May 2, 2007. This drug was administered in violation of New York State Racing and Wagering Board rules 4043.2 and 4043.4. Said horse is hereby disqualified and unplaced in the order of finish. You shall also be denied the privileges and use of the grounds of each and every New York State racetrack and no horse owned or trained by you and your agents shall be allowed to participate in racing in New York State. During your period of suspension you shall not participate in New York State pari-mutuel horse racing, directly or indirectly, you shall be denied the privileges and use of the grounds of New York State racetracks, and you shall be forbidden to participate in any share of the purses. Horses owned or trained by you, or those employees or agents who continue to serve as your agents or employees during such period of suspension; and horses in regard to which you are making arrangements with any owners, directly or indirectly, to care for, train, enter in races, invoice, collect fees or other payments, employee workers, or otherwise handle; shall not be allowed to participate in pari-mutuel racing and are denied the privileges of the grounds. This shall not preclude agents or employees of you, who are not serving as such during the period of your suspension, from participating in pari-mutuel racing as owners, trainers, and grooms, as long as they are licensed and perform those duties consistent with the rules and regulation of the State of New York.
