Ruling Text: Order to Show Cause why you failed to obey the instructions of a racing official appointed or designated by the New York State Racing and Wagering Board (NYSRWB) relative to Fine & Suspension notice YR 57-2007. FINDING & ORDER, JUNE 3, Gail Pronti: ORDERED, that judges in harness racing have the authority to require licensees to appear personally to answer for their activities at the race track, the obligation of the licensee to meet with a judge cannot be met unless the licensee appears in person, and the licensee cannot satisfy her obligation to obey such directive by sending an attorney in her place; ORDERED, that respondent failed to comply with a directive of the Board, in violation of 9 NYCRR §§ 4119.7(a)(5), 4105.6(b, e, f), and 4105.8(f), in that she failed and refused to attend, as directed by the Presiding Judge at Yonkers Raceway, a meeting he scheduled to discuss on May 19, 2007 her alleged involvement in and concealment of untimely race-day furosemide administrations; and ORDERED, that respondent should be accorded an opportunity to address the issue of penalty and, accordingly, this violation is remanded to the Hearing Officer for further proceedings in regard to its penalty and into her alleged underlying misconduct.
