Ruling Text: As Trainer of Record of Sand Sax who was scheduled to race on 5/07/2007 in the 9th race post #3. The horse’s TCO2 level at that time exceeded the acceptable level as set forth in the above rules. During this period of your suspension you are denied the privileges of the grounds, no horses owned, trained, or driven by you shall be allowed to participate at any racetrack conducting pari-mutuel racing. FINDING & ORDER, March 27, 2009, Gail Pronti; ORDERED, as the Board has previously determined, there is no requirement that pre-race TCO2 blood samples be drawn more than a 3:00 hour interval after the administration of race-day furosemide (lasix) for the TCO2 test result to be valid; and ORDERED, the TCO2 test result and time interval after lasix in this appeal are not distinguishable from those in Mtr. of Tina Adamczyk (MR 01-2008); and ORDERED, that the charge is hereby dismissed on the ground that the evidence is insufficient to sustain the charge against respondent.
