Ruling Text: #8 (Bailey Blazes) in the 1st Race tested positive for an unacceptable level of TCO2. The horses' TCO2 level at that time exceeded the acceptable level as set forth in NYSHRR 4120.13(A). As Trainer of Record you are the absolute insurer of the horse, and are responsible for its' condition and well-being. This violation constitutes actions by you that are detrimental to the best interests of racing. During this period of suspension you are denied the privileges of the grounds, and no horses owned, trained, or driven by you or your agents shall be allowed to participate at any track conducting pari-mutual wagering. FINDINGS AND ORDER, 2/26/2008, Gail Pronti; ORDERED, that the Decision of the Presiding Judge at Buffalo Raceway that respondent Victoria L. Campbell, as responsible trainer, violated 9 NYCRR §§ 4120.16 [now 4120.13] and 4120.4, in that the horse "Bailey Blazes," trained by her, competed at Buffalo Raceway on February 23, 2007 with a pre-race TCO2 level of 39 millimoles per liter or more as shown by appropriate testing and not determined to be its physiologically normal level pursuant to 9 NYCRR § 4120.16, is affirmed; ORDERED, that the Decision of the Presiding Judge at Buffalo Raceway to impose a fine of one thousand dollars ($1000) and a 60 day license suspension, is affirmed; ORDERED, that respondent should be credited for time served during her voluntary absence from any record participation in pari-mutuel racing since the date of the Presiding Judge’s ruling, March 7, 2007, because of the unique facts and circumstances by which her absence appears inexplicable or based on a misunderstanding of her stay; and ORDERED, that respondent has, therefore, completed her 60 day suspension.
