| Ruling Text: Prior to March 23, 2007, you had been warned by the Presiding Judge that after your horse had raced, by rule, you must leave the Paddock before the post parade of the following race. On this date you entered the Paddock as Owner-Groom of #5 (Ruby Hall) in the 3rd Race. You remained there, loitering in the lounge well past the 5th race. When an investigation was conducted, you fraudulently explained that you were grooming the horse, when in fact, that was not the truth, and that did not entitle you to remain in the Paddock. Your privileges to enter the Paddock for any reason has been revoked for one (1) year, both from Buffalo Raceway and Batavia Downs, beginning March 24, 2007, through March 24, 2008. STIPULATION OF SETTLEMENT, August 1, 2007, Rick Goodell. On appeal, Stipulation of Settlement agreement dated 8/8/2007. Board found respondent as a licensed owner failed to leave the paddock prior to the post parade of the race following the last race in which his horse competed at Buffalo Raceway on March 23, 2007, in violation of 9 NYCRR 4104.8(d). Board also found that there was no evidence to suggest that he engaged in any independently wrongful conduct in the paddock. Agrees to a curtailment of his paddock privileges for one year of which the final portion, starting on 8/8/2007, shall be stayed, and thereafter discharged, provided that during the year he does not commit any violation of the Board rules relating to the paddock. The curtailment period shall begin on 3/23/07. Agrees to pay fine of $1000. |
