| Ruling Text: As trainer of record of #8(E Dees Diamond J) that raced in the 5th race on January 11, 2007 finishing 2nd, the horse's TCO2 level at that time exceeded the acceptable level set forth in the above rules. During the period of your fine & suspension you are denied the privileges of the grounds. No horses owned, trained, or driven by you shall be allowed to participate at any track conducting pari-mutuel racing. Stipulation of Settlement (YR 18-2007 & YR 19-2007) 6/7/2007, agreed to a suspension of 135 days, beginning March 24, 2007 and ending August 5, 2007 and the payment of a fine of Three Thousand Five Hundred ($3,500.00) which is due on or before August 5, 2007.
