| Ruling Text: #3 (Jimmy Crack Cohen) in the 7th Race tested positive for an unacceptable level of TCO2. The horse's TCO2 level at that time exceeded the acceptable level as set forth in NYSHRR 4120.13(A). As the trainer of record you are the absolute insurer of the horse, and are responsible for the condition and well-being of the horse. This violation constitutes actions by you that are detrimental to the best interest of racing. You are hereby ordered to relinquish any purse money won in that race for re-distribution. You are also ordered to pay One Thousand ($1000.00) Dollars, and your license to participate as a Trainer in the State of New York is suspended for Sixty (60) Days, April 30, 2006, through June 28, 2006, during this time you are denied the privileges of the grounds at all pari-mutuel race tracks within the State of New York. You are eligible to participate on June 29, 2006. Having appeared before a representative of the New York State Racing and Wagering Board, and appealed this decision, your suspension is hereby stayed, pending a final decision by the Board. FINDING AND ORDER, 11/30/2007, Gail Pronti, Ordered that the Decision to impose a fine of one thousand dollars ($1,000) and a 60 day license suspension, is affirmed, this suspension shall be effective at the discretion of the Presiding Judge.
