| Ruling Text: NO ACTION TAKEN AGAINST THE TRAINER 2/20/2005 4TH RACE HORSE ITCHY DISQUALIFIED AND UNPLACED FOR THE FINDING OF THE DRUG FLUPHENAZINE IN POST RACE SAMPLES FINDING AND ORDER, 9/24/2009, Gail Pronti: ORDERED, that “Morph,” a horse trained by respondent in the 2nd race at Aqueduct Racetrack on February 17, 2005, was properly found by the official racing chemical detection laboratory designated by the Board to have the drug fluphenazine in its post-race sample, in violation of 9 NYCRR 4043.7(a); ORDERED, that the horse “Morph” is disqualified and unplaced from the 2nd race at Aqueduct Racetrack on February 17, 2005, and from any share of the purse in the race, and that the purse monies be redistributed accordingly; ORDERED, that “Itchy,” a horse trained by respondent in the 4th race at Aqueduct Racetrack on February 20, 2005, was properly found by the official racing chemical detection laboratory designated by the Board to have the drug fluphenazine in its post-race sample, in violation of 9 NYCRR 4043.7(a); and ORDERED, that the horse “Itchy” is disqualified from the 4th race at Aqueduct Racetrack on February 20, 2005, and from any share of the purse in the race, and that the purse monies be redistributed accordingly. |
