Ruling Text: VIOLATION OF NYSRWB RULE 4012.1. FINDINGS AND ORDER DATED MAY 4, 2006 ORDERED, that the Board upholds the violation and modifies the penalty from a sixty (60) day suspension to a sixty (60) day suspension with an addition sixty (60) day suspension imposed but deemed waived provided Ms. Pederson does not violate parts of 4012 or 4043 of the Board's rules within the one (1) year period beginning on the first effective date of the suspension. The Board's modification of the penalty is based upon the seriousness of the violation and the need to deter conduct, which goes to the heart of pari-mutuel racing activity. Administrative Stay Stipulation 7/25/2006 re: institution of Article 78. Your penalty for the violation shall be a suspension of 120 days, except that 60 days of your suspension shall be stayed, and thereafter discharged, provided that during the next year (366 days) you commit no violation of Board equine drug rules and you fully comply with the terms of this ruling. January 4, 2008 through March 3, 2008 inclusive. If you commit such a violation or failure to comply, then you shall serve this full penalty in addition to any penalties imposed for the new rule violation(s). Your suspension and probationary periods shall begin simultaneously on January 4, 2008. During the period of suspension, you shall not directly or indirectly participate in New York State pari-mutuel horse racing, you shall be denied the privileges and use of the grounds of New York State racetracks, you shall be forbidden to participate in any share of the purses. Every horse shall be denied the privileges of the grounds and shall not participate in pari-mutuel racing (i) that is owned or trained by you during your period of suspension, (ii) that is owned or trained by an individual who continues to serve as your agent or employee during your period of suspension, or (iii) for which you directly or indirectly make or execute, during your period of suspension, any arrangement with owner or other person to care for, train, enter in a race, invoice, collect fees or other payments related to, employ workers for, or otherwise handle. This shall not preclude your pre-suspension agents or employees, who are serving as such during your suspension period, from participating in pari-mutuel racing as owners or trainers provided that they are duly licensed and perform their duties in compliance with the rules and regulations of the State of New York.
