| Ruling Text: Mark Tasso, as responsible trainer under 9 NYCRR § 4043.4(a), violated Commission rules in that respondent trained a horse, "April Fog", which finished 1st in the fourth race at Finger Lakes Racetrack on September 29, 2018 and (1) the drug Phenylbutazone had been administered within 48 hours before the scheduled post time of its race, in violation of 9 NYCRR § 4043.2(e)(14); and (2) the laboratory conducting tests for the commission determined that a race-day blood sample taken from the horse had the substance Phenylbutazone present at a concentration, including an assessment of the measurement uncertainty and imprecision of the quantitative threshold, in excess of 2 mcg/ml in plasma in violation of 9 NYCRR § 4043.3(a)(23).
Having withdrawn his appeal of the Stewards decision, Owner/Trainer Mark Tasso is suspended for 15 calendar days, effective Sunday, May 26, 2019 through Sunday, June 9, 2019, inclusive, and fined $750. In a previous ruling "April Fog" was disqualified from any part of the purse and the purse redistributed.
