***FINDINGS AND ORDER***
The New York State Gaming Commission (“Commission”) conducted a hearing in this matter pursuant to Section 220(2) of the Racing, Pari-Mutuel Wagering and Breeding Law (Racing Law), Article 3 of the State Administrative Procedure Act, and Part 4550 of the Commission’s rules at 9 NYCRR, at the request of jockey Javier Castellano (“Respondent”) after the Steward of the Commission at Saratoga Race Course fined him $2,000 for careless riding in the 3rd race at Saratoga Race Course on August 15, 2018.
Respondent received proper notice and participated in a hearing conducted on August 29, 2018. The Hearing Officer rendered his report on September 17, 2018, which is attached and incorporated herein, finding that the ruling against Respondent should be sustained.
The Commission met on December 10, 2018, and after due deliberation adopted the Hearing Officer’s findings of fact and conclusions of law.
THEREFORE, upon the record, the report of the Hearing Officer and the findings and conclusions adopted by the Commission, it is hereby,
ORDERED, that Respondent’s violation and fine in the amount of $2,000 are affirmed, and
ORDERED, that Respondent shall be ineligible to participate in racing unless and until his fine is paid and that failure to pay within 30 days, i.e., by his delinquency date of January 9, 2019, will result in the assessment of interest and/or a late payment charge and may result in other collection charges. |
