Gaming Commission

As trainer of record for #1 FIRST AFTER ME, who finished 2nd in the 12th race at Buffalo Raceway on January 30, 2013 and whose post race test was positive for Flunixin, you are in violation of the above stated rules.  FIRST AFTER ME is disqualified and the purse is to be redistributed.  After meeting with a representative of the NYS Gaming Commission, reviewed your penalty and having waived your right of appeal, your fine is reduced from $500.00 to $250.00 and your suspension reduced from 15 days to 7 days.  You are eligible to participate on February 21, 2013.  During the period of your suspension you shall not directly or indirectly participate in New York State pari-mutual horse racing.  You shall be denied the privileges & use of the grounds and shall not participate in any share of the purses.  Every horse shall be denied the privileges of the grounds and shall not participate in pari-mutual racing (i) that is owned or trained by you during your period of suspension, (ii) that is owned or trained by any individual who continues to serve as your agent or employee during your period of suspension, or (iii) for which you directly or indirectly make or execute during your period of suspension, any arrangement with an owner or other person to care for, train, enter in to race, invoice, collect fees or other payments related to, employ workers for, or otherwise handle.  This shall not preclude your pre-suspension agents or employees who are not serving as such during your suspension period, from participating in pari-mutual racing as owners or trainers provided they are duly licensed and perform their duties in compliance with the rules and regulations of the State of New York.
