Gaming Commission

You are hereby suspended 30 days, having waived your right of appeal this suspension is reduced to 15 days March 11, 2013 through March 25, 2013 inclusive and fined $1000.00. This for the finding of the drug Clenbuterol in the post race samples of horse Alvito who finished 1st in the 5th race on February 24, 2012. This drug was administered in violation of New York State Gaming Commission rule 4043.2 and 4043.4. Alvito is hereby disqualified and unplaced in the order of finish.

Ordered that during your suspension, you shall not directly or indirectly participate New York state pari-mutuel racing, you are denied the privileges and use of the grounds for all racetracks, you are forbidden to participate  in any share of the purses or other payments. Every horse is denied the privileges of the grounds and shall not participate in pari-mutuel racing in New York, further that is (a) owned or trained by you, or any individuals who serve as you agents or employee during your suspension; or (b) for which you during your suspension are directly or indirectly with training, including any arrangements to care for, train, enter, race, invoice, collect fees or other payments, manage funds, employ workers, provide advise or information, or otherwise assist with any aspect of the training of the horse.
