| Ruling Text: AFTER CAREFUL CONSIDERATION, YOU ARE HEREBY NOTIFIED THAT THE BOARD REFUSES TO ISSUE YOU A LICENSE TO PARTICIPATE IN RACING IN THE STATE OF NEW YORK, FOR WHICH YOU APPLIED ON 10/8/2011, RECEIPT# SR 1332314, FOR THE FOLLOWING REASON: YOU HAVE VIOLATED A RULE (4119.11) OF THE NEW YORK STATE RACING & WAGERING BOARD. 1/29/13 Respondent Rory J. Adams having timely filed an appeal of the Notice of Refusal, dated June 14, 2012, of the New York State Racing and Wagering Board (“Board”) to license him as an owner, trainer, or groom in harness racing in New York State based on a human sample taken April 14, 2012, that tested positive for a prohibited substance in violation of 9 NYCRR 4119.11(a); and respondent having received proper notice and having failed to appear at a hearing conducted on January 3, 2013; and the Hearing Officer having rendered his Report on January 7, 2013, which is attached hereto and incorporated herein; now the Board, after due deliberation, hereby adopts the Hearing Officer’s findings of fact and conclusions of law. THEREFORE, upon the record, the Report of the Hearing Officer and the findings and conclusions herein, it is hereby ORDERED, that respondent received sufficient notice of his hearing date, and that if he failed to appear then his appeal would be deemed withdrawn; ORDERED, that respondent failed to appeal at his hearing date and his appeal, therefore, is deemed to have been withdrawn; and ORDERED, that the Notice of Refusal to license respondent Rory J. Adams be, and hereby is, affirmed. |
