Ruling Text: YOU ARE HEREBY ORDERED to SHOW CAUSE, before the New York State Racing and Wagering Board (“Board”) at its main office located at 1 Broadway Center, Suite 600, Schenectady, New York, 12305 on December 3, 2010, at 10:00 A.M., pursuant to Section 309, subdivision 2 of the Racing, Pari-Mutuel Wagering and Breeding Law ("Racing Law"), and the Rules and Regulations of The New York State Racing and Wagering Board, 9(E) NYCRR Parts 4101, 4102, 4116.9, 4117 and 4119: Why your license to participate in pari-mutuel harness racing should not be denied, suspended or revoked, and/or why you should not be barred from applying for a license for a time period to be determined and/or a fine imposed and why you should not be expelled from pari-mutuel harness racing in New York State. PER BOARD FINDINGS AND ORDER DATED JULY 5, 2011: ORDERED, that any and all Racing and Wagering Board licenses currently held by Respondent Joshua Marks are revoked and any formerly existing license rights are terminated; and that any future licenses may only be obtained upon the conditions set forth in the Hearing Officer’s Report and those that may be determined by Board staff; and Respondent is hereby fined in the sum of $500; and it is further ORDERED that the fine must be paid by July 19, 2011. If not paid by August 4, 2011, Respondent will be assessed interest or a late payment charge and may be subject to further Board action, and it is further ORDERED that Respondent, Joshua Marks is excluded from the grounds of all racetracks under the jurisdiction of this Board, whether as a patron or otherwise pursuant to Rule 4119.8, until such time as he may be granted licensing privileges on conditions consistent with the recommendations of the Hearing Officer and those that may be determined by Board staff to be necessary to assure his fitness to participate in racing as well as the safety of participants and the integrity of racing.
