| Ruling Text: PLEASE TAKE NOTICE that your license to participate in pari-mutuel harness racing as an owner, trainer and groom is hereby SUSPENDED IMMEDIATELY pending the disposition by the Board of the scheduled hearing before the New York State Racing and Wagering Board or, if you refuse such hearing or default in appearing, SUSPENDED until such time as the Board in its discretion takes further action, including but not limited to license suspension or revocation or refusal to license. FINDING AND ORDER, February 28, 2011, Kristen M. Buckley: ORDERED, that the October 13, 2010 summary suspension be and is hereby upheld, and further ORDERED that, as a result of the violations of 9 NYCRR §§ 4120.2, 4120.4 and 4120.6, Mr. Cumming’s license to participate as an owner, trainer and groom in harness racing be, and is hereby, revoked, and it is further ORDERED that Mr. Cummings not be permitted to obtain a license to participate in pari-mutuel racing for a period of five (5) years commencing February 24, 2011; and ORDERED, that Mr. Cummings is denied the privileges of the grounds, whether as a patron or otherwise, of all racetracks under jurisdiction of the Board. |
