Ruling Text: PLEASE TAKE NOTICE that your license to participate in pari-mutuel harness racing as a trainer is hereby SUSPENDED IMMEDIATELY pending the disposition by the Board of the scheduled hearing before the New York State Racing and Wagering Board or, if you refuse such hearing or default in appearing, SUSPENDED until such time as the Board in its discretion takes further action, including but not limited to license suspension or revocation or refusal to license. FINDINGS AND ORDER, August 5, 2011, Kristen M. Buckley: ORDERED, that the Board’s summary suspension of Mr. Nappo’s license as an owner and trainer is hereby upheld; and it is further ORDERED, that the Hearing Officer’s recommendation of a six month license suspension and $250 fine is rejected as insufficient under the facts and circumstances; and it is further ORDERED, that Mr. Nappo’s license be revoked, the fine in the amount of $250 is affirmed, and that he be ineligible to reapply for a minimum period of two (2) years from the date of the summary suspension despite the absence of any other equine drug-related violations because in the judgment of the Board his conduct is antithetical to assuring the integrity of pari-mutuel horse racing and establishes that his character and fitness are unsuitable for his continued participation in racing for at least two (2) years; and it is further ORDERED that the fine must be paid by August 19, 2011, and if not paid by September 5, 2011, Respondent will be assessed interest or a late payment charge and may be subject to further Board action; and it is further ORDERED, that during the period of his revocation, respondent and while unlicensed Angelo J. Nappo shall not directly or indirectly participate in New York pari-mutuel horse racing, he is denied the privileges and use of the grounds of all racetracks, and he is forbidden to participate in any share of purses or other payment. Every horse, moreover, is denied the privileges of the grounds and shall not participate in pari-mutuel racing in New York State that is (a) owned or trained by him, or any individual who serves as his agent or employee, during his revocation and/or suspensions; or (b) for which he, during his revocation and/or suspensions and/or while unlicensed is involved, directly or indirectly, with its training including but not limited to arrangements made to care for, train, enter, race, invoice, collect fees or payments, manage funds, employ or insure workers, provide advice or information, or otherwise assist with any aspect of the training of the horse.
