| Ruling Text: Given the Board’s denial on June 30, 2009 of the harness owner license application of Tyler Kolaczynski, the rule violations stated in his denial notice (MO 269-2009), and the determination that Wize Advisors LLC stable has been owned and/or operated by an unlicensed person, I hereby rule that its following horses were entered and started in violation of Board rules 4111.3, 4111.20, and 4111.32; were not eligible to race; and are disqualified from the belowstated races at Saratoga Raceway (“SR”) and from the resulting purses, which are currently withheld by Saratoga Harness Racing, Inc.: 1. Blissfull Doll: 6/14/09 Race 3 (3rd, $540), 6/07/09 Race 5 (4th, $384); 2. Blissfull Jessie: 6/28/09 Race 9 (1st, $8500), 6/21/09 Race 10 (3rd, $1260), 6/14/09 Race 9 (5th, $850), 6/07/09 Race 10 (1st, $5250), 5/10/09 Race 10 (4th, $840) SR currently holding $315; 3. Boston Babe: 6/14/09 Race 7 (3rd, $720); 4. Capital Advisor: 6/06/09 Race 11 (4th, $720); 5. Crownprince Volo: 6/19/09 Race 10 (1st, $5250), 6/12/09 Race 10 (3rd, $1260); 6. Okuni: 6/26/09 Race 12 (1st, $2200), 6/19/09 Race 12 (2nd, $1100), 6/12/09 Race 12 (2nd, $1100); and 7. Solano: 6/13/09 Race 8 (5th, $440), 6/06/09 Race 10 (5th, $525). I refer these issues to the Board for consideration as they relate to the horses Ace MacTavish (10 races at SR from 6/27 to 12/06/08), Aquilea (6 races at SR from 5/17 to 10/31/08), Blissfull Doll (8 other races at SR from 4/11 6/25/09), Blissfull Jessie (30 other races at SR from 5/23/08 to 5/25/09), Boston Babe (13 other races at SR from 7/03 to 12/20/08), Capital Advisor (10 other races at SR from 3/14 to 6/13/09), Crownprince Volo (15 other races at SR from 2/25 to 7/03/09), Four Starz Bling (20 races at SR from 8/30/08 to 5/30/09), Midland Cruiser (raced at SR on 11/29/08), Miracles Delight (raced at SR on 6/25/09), Okuni (raced at SR on 6/05 and 7/03/09), Solano (9 other races at SR from 3/01 to 5/30/09), and Spike Cider (3 races at SR from 12/05/08 to 3/06/09). I direct that Saratoga Gaming and Raceway continue to withhold the purse of Capital Advisor, 6/13/09 Race 7 (1st, $3800) pending a decision of the Board concerning such fraud and ineligibility. I refer to the Board for consideration whether additional action, including but not limited to exclusion from racetracks and monetary fines, should be imposed against Tyler Kolaczynski and Wize Advisors LLC. |
