| Ruling Text: 1. The Board and Gary C. Contessa hereby agree to the disposition of his pending matters as set forth herein; 2. Gary C. Contessa agrees that his directives and his continued receipt of trainer commissions from purses won during his suspension period by his former horses were violations of his suspension imposed pursuant to the aforesaid Notices of Suspension, Revocation and Fine denoted BL 25/07 and BL 54/07; 3. Gary C. Contessa agrees that he shall pay a total fine of Fifteen Thousand Dollars ($15,000), with Ten Thousand Dollars ($10,000) due and payable on or before October 24, 2008 and the balance of Five Thousand Dollars ($5,000) stayed and thereafter to be discharged, provided that during the next year Gary C. Contessa not commit any major violation of Board Rules (including any violation of equine drug rules) and that he complies with the terms of this Stipulation of Settlement, including the timely payment of his fine. His probationary period shall begin on Friday, October 24, 2008, at 12:01 a.m. 4. Gary C. Contessa waives his right to bring a judicial challenge to any of the actions of the New York State Racing and Wagering Board, its members, agents, or employees, with respect to these matters, in any state or federal court or other forum. 5. Gary C. Contessa has read all of the above conditions and understands and agrees to comply with these conditions. Gary C. Contessa understands that his participation in racing is conditioned upon his compliance with this agreement. 6. This Settlement Agreement represents the full, final and complete resolution of this matter. |
