| Ruling Text: YOU ARE HEREBY ORDERED TO SHOW CAUSE, before the New York State Racing and Wagering Board at its main office located at One Broadway Center, Schenectady, New York on AUGUST 26, 2008, at 10:00A.M., why, pursuant to Racing, Pari-Mutuel Wagering and Breeding Law §213 subdivision 2 and 3, Article 3 of the State Administrative Procedure Act and 9 NYCRR, Part 5402, and New York Thoroughbred Racing Rules §§ 4002.8, 4002.9, and 4002.10 your license to participate as a Groom in pari-mutuel thoroughbred racing should not be suspended or revoked because your experience, character and general fitness are such that participation in thoroughbred racing by you would not be in the best interest of racing or the public interest, convenience or necessity, or in the best interest of racing generally in that: 1. On August 5, 2008, you did commit the crime of Rape in the First Degree, in violation of Penal Law §130.35 subdivision 1, a Class B felony. FINDINGS AND ORDER, 10/28/2008, Gail Pronti; ORDERED, that the license of Respondent is revoked pursuant to Rules §§4002.8, 4002.9(a) and 4002.10 upon the grounds that his experience, character and general fitness are such that participation in racing by him would be inconsistent with the public interest convenience or necessity, or in the best interest of racing generally.
