| Ruling Text: As trainer of record of # 3 R U BARTLETT that finished 3rd in the 5th race on 02/12/2008, your horse's TCO-2 level exceeded the acceptable level of a non lasix horse, being in violation of the above stated rules. iii. the penalty is a one year suspension for additional violations, and a five thousand ($5000.) fine, together with a referral to the NYS Racing & Wagering Board for further action, including a possible license revocation. The horse is disqualified and purse monies to be returned. During the period of your suspension you are denied the privileges of all grounds subject to the jurisdiction of the NYSR&WB . Having appeared before a representative of the NYSR&WB and having filed an appeal, and paid your fine, your suspension is stayed pending final determination of the Board. Horses will remain on the pre race detention list. ORDER TO SHOW CAUSE, Gail Pronti, March 10, 2008; Ordered to Show Cause why you should not be fined, your license to particpate in pari-mutuel harness racing not be suspended or revoked and your not be excluded from all New York State tracks. (See MO 182-2008) 1/30/2009 Sullivan County Supreme Court stayed the most recent Board penalties (attached, MO 182/08), until he concludes his article 78 proceedings |
