Ruling Text: You failed to follow a directive to return purse monies in the amount of $5,400.00 by May 4, 2007. This is regarding the race involving, "Yonkers Hall" on November 11, 2006 at Saratoga Gaming & Raceway. FINDING & ORDER, 2/28/2008, Gail Pronti; ORDERED, that the Decision (SR 26-2007) of the Presiding Judge at Saratoga Raceway to fine respondent Steven F. Nanna, for willfully failing to obey his directives, in violation of 9 NYCRR §§ 4119.7(a)(5), 4120.5, and 4105.6, in that, respondent refused to obey his repeated directives to return the purse when his horse, “Yonkers Hall,” was disqualified from its race at Saratoga Raceway on November 11, 2006 for testing positive for ipratropium, is affirmed; and ORDERED, that the Decision (SR 25-2007) of the Presiding Judge at Saratoga Raceway also to suspend indefinitely the owner license of respondent Steven F. Nanna for such violation, is affirmed; and ORDERED, that the suspension of respondent’s owner license shall terminate upon payment of his fine, provided that, because the Board finds that compliance with the underlying directive is essential to the best interests of racing, respondent has also complied with the underlying directive to return the subject purse monies to Saratoga Raceway.
