Ruling Text: HEREBY SUSPENDED IMMEDIATELY. RESPONDENT'S EXPERIENCE, CHARACTER AND GENERAL FITNESS ARE SUCH THAT PARTICIPATION IN HARNESS HORSE RACE MEETS ARE INCONSISTENT WITH THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY AND THE BEST INTEREST OF RACING GENERALLY. FINDING & ORDER, APRIL 29, 2008, GAIL PRONTI: ORDERED, that respondent Robert R. Moscone committed the aforesaid serious Board Rule violations, that he lacks the character and fitness necessary to participate in pari-mutuel racing, and that his continued participation in pari-mutuel racing is inconsistent with the public interest, convenience, and necessity and with the best interests of racing generally; ORDERED, that respondent’s occupational license to participate in pari-mutuel racing is hereby revoked, in that, revocation of his license, which did not expire until after his hearing was conducted, is the appropriate final agency action; and ORDERED, that while respondent is revoked he shall not participate directly or indirectly in New York State pari-mutuel horse racing, he shall be denied the privileges and use of the grounds of New York State racetracks, he shall be forbidden to participate in any share of purses, and every horse that is owned by respondent (or by those employees or agents who continue to serve as his or her agents or employees during his revocation) is denied the privileges of the grounds and may not participate in pari-mutuel racing. 5/28/08- The New York State Racing and Wagering Board determined that Robert R. Moscone committed the charged violations of Board rules, lacks the character and fitness necessary to participate in pari-mutuel racing, and that his continued participation is inconsistent with the public interest, convenience, and necessity, and with the best interests of racing generally. The Board revoked Mr. Moscone’s occupational license and determined that the revocation of the license is the appropriate final agency action.
