Ruling Text: SUMMMARILY SUSPENDED: Under the present circumstances you lack the general character and fitness for continued participation in pari-mutuel racing and your continued participation in pari-mutuel racing is presently inconsistent with the public interest, convenience and necessity and with the best interest of racing generally. The license to particpate in pari-mutuel harness racing as an owner/traine and otherwise are hereby suspended immediately. FINDINGS AND ORDER, 2/26/2008, GAIL PRONTI; ORDERED, that the evidence is insufficient to sustain the charge that, on February 23, 2007, John Leggio, as responsible trainer, violated [then] 9 NYCRR §§ 4120.16 and 4120.4, in that, the horse “Howbizar Howbizar," trained by him, competed at Buffalo Raceway with a pre-race TCO2 level of 39 millimoles per liter established pursuant to [then] 9 NYCRR § 4120.16; ORDERED, that on February 24, 2007, respondent John Leggio, as responsible trainer, did violate [then] 9 NYCRR §§ 4120.16 and 4120.4, in that, the horse "Rainy Day Sam," trained by him, competed at Buffalo Raceway with a pre-race TCO2 level of 37 millimoles per liter or more as shown by appropriate testing and not determined to be its physiologically normal level pursuant to 9 NYCRR § 4120.16; ORDERED, that for this serious violation, given his persistent and serious history of Board rule violations including numerous equine drug-positives for which he continues not to accept responsibility, respondent John Leggio’s occupational licenses to participate in pari-mutuel racing are hereby, and he is declared ineligible to reapply for five (5) years, to wit, until February 26, 2013; and ORDERED, that this revocation shall be effective immediately in view of the existing summary suspension of respondent John Leggio.
